CySEC License: What It Covers and How to Check One
What a CySEC authorisation permits, why Cyprus became a common jurisdiction for crypto service providers, and how to verify a licence properly.
CySEC, the Cyprus Securities and Exchange Commission, authorises a substantial number of the crypto asset service providers operating across the European Union. Understanding what that authorisation covers is useful when comparing providers, and verifying it is straightforward. Read against an authorised crypto asset service provider, the distinctions below stop being academic.
Why Cyprus
Three reasons, none of them exotic.
It is an EU member state, so authorisation passports across the union. It has a long-established regulatory apparatus for investment firms, which meant the supervisory capability existed before crypto services required it. And it moved early on a crypto asset service provider regime, so providers seeking European authorisation had a route there before several other member states.
The result is concentration. That concentration is a matter of regulatory timing and infrastructure rather than of standards, and a CySEC authorisation carries the same obligations as authorisation elsewhere in the union.
What the authorisation covers
A CySEC authorisation for a crypto asset service provider specifies which services are permitted. The distinct permissions include custody and administration of crypto assets, operation of a trading platform, exchange of crypto assets for funds, exchange of crypto assets for other crypto assets, execution of orders, placing, reception and transmission of orders, advice, and portfolio management.
A provider may hold some and not others. This is the part most people skip and it is the part that matters. An entity authorised to exchange crypto for funds is not thereby authorised to hold your assets in custody.
The obligations that follow
Minimum capital scaled to the services provided. Segregation of client assets, separately identifiable and not usable by the firm. Fit and proper assessment of management and qualifying shareholders. Governance, risk management and internal audit functions. Complaint handling with defined timelines. Regular reporting to the regulator and periodic inspection.
Plus anti money laundering obligations supervised by the same authority.
How to verify a licence
CySEC maintains a public register. Search by entity name or licence number.
Check four things. The entity name matches exactly the entity in your contract, not a group brand. The licence is current rather than lapsed, suspended or withdrawn. The permissions cover the services you intend to use. And there are no conditions attached to the authorisation. Where client money is involved the requirements change entirely, which is what a regulated crypto custody provider is built to satisfy.
The register also shows enforcement history, which is worth reading. A firm with a history of sanctions is not automatically disqualified, but the nature of the sanction is informative.
Where people go wrong
Accepting a licence number without checking it. Numbers get reused in marketing copy and occasionally belong to a different entity in the same group.
Confusing an investment firm licence with a crypto asset service provider authorisation. Some firms hold both, some hold one, and they permit different things.
Assuming authorisation covers the specific service. Custody is the permission that most often turns out to be missing.
Not rechecking. Authorisations change. An annual check takes five minutes.
What it does not tell you
Whether the firm is well capitalised beyond the minimum, whether its technology is sound, or whether its pricing is competitive. Authorisation is a floor, not a ranking.
It does tell you that a supervisor has assessed management, that client assets must be segregated, and that there is an authority to complain to that has powers. Against an unauthorised alternative, that is a substantial difference.
The practical use
Use it as a filter at the start of a selection process. Providers holding a CySEC authorisation for crypto asset services can be verified in minutes, and anyone who cannot be verified in minutes is not worth the remaining diligence.
